1) Applicability of Terms and Conditions

1.1 thelittlegoldsmith.ch, Hauptstrasse 15, 5043 Holziken, Switzerland, represented by Ms. Laura Franke and Mr. Samuel Demir

Hereinafter referred to as TLG

is the issuer of these Terms and Conditions.

1.2 All products and services offered in the TLG online shop are provided exclusively on the basis of these Terms and Conditions. By placing an order, the Terms and Conditions are considered accepted. The version valid at the time of the order applies. Any general purchasing conditions or differing conditions of the customer are explicitly excluded.

1.3 TLG is entitled to amend or supplement these Terms and Conditions at any time. Side agreements, assurances, and other agreements as well as amendments and supplements to these Terms and Conditions must be in writing to be effective.

2) Offer

2.1 The products and services offered in the TLG online shop are primarily intended for persons (adult natural and legal persons) residing in Switzerland.

2.2 Product images in advertising, brochures, or in the TLG online shop are for illustration purposes only and are non-binding. The same applies to product information and prices, as they are for informational purposes only. Only the manufacturer’s information (e.g., applicable manufacturer warranties) valid in Switzerland is decisive.

2.3 Prices are in Euro, including current VAT (currently 8,1%) and, where applicable, advance recycling fees ("vRG"). All packaging and shipping costs, except return costs, are free of charge for the customer.

2.4 Orders in the TLG online shop are subject to the prices offered at the time of ordering. TLG reserves the right to change prices at any time. The offer is valid as long as the product is found via the online shop search engine and/or is still available.

2.5 All information regarding availability and delivery times is indicative and non-binding. In exceptional cases (supplier shortages, high-demand products), delivery times may be longer. Current delivery times can be viewed on each product page. TLG strives to keep the website and offered products up to date to ensure customer satisfaction.

2.6 TLG reserves the right to cancel orders at any time without giving reasons.

3) Conclusion of Contract

3.1 By ordering a product, the customer makes a binding declaration of intent. Immediately after completing the purchase, TLG confirms receipt of the order by email. A contract is only concluded after confirmation of actual delivery availability and price by TLG, usually within five business days. Until then, the customer may cancel the order without reason.

3.2 If delivery is partially or completely impossible after confirmation, the customer will be informed immediately by email. Any payment already made will be refunded without interest. If no payment has yet been made, the customer is released from the payment obligation. Further claims for delivery delay or failure are excluded (see section 10).

3.3 There is no general claim to return ordered products. Products not marked as "custom-made" or "no return, exchange only" and for which a return right is granted may be returned within 28 calendar days of receipt under the following conditions:

The product is in its original condition, including seals, original string, labels, and protective films, and undamaged.
The product and all accessories are in the original packaging.

4) Delivery/Pick-up and Acceptance Default

Notification of delivery or pick-up is by email or by personal contact. All dates are approximate. If the customer refuses acceptance after a set deadline, TLG may refuse performance and claim damages of either 25% of the agreed price or the actual damage. If contact fails three times and the repair is not picked up, TLG may retain the goods after three months unless agreed otherwise.

5) Delivery

5.1 Visible quantity differences must be reported immediately to the carrier; hidden differences within five days. Claims for damaged or incomplete packages must be reported immediately.

5.2 All packaging and transport costs, including insurance, are borne by TLG free of charge.

5.3 Shipping within Switzerland is free for orders over CHF 40.

6) Prices and Payment

6.1 All prices are in Swiss Francs, including VAT and other price components.

6.2 Payment options include credit card, installment, invoice, direct debit, PayPal, instant transfer, and Amazon Payments. TLG may exclude certain payment methods for credit risk protection.

6.3 Using external providers like PayPal or Apple Pay also subjects the customer to their T&Cs.

6.5 Goods are delivered only after full payment. Outstanding amounts are immediately due.

7) Retention of Title

All ordered items remain TLG property until full payment is received.

8) Transfer of Risk

Risk passes to the buyer when the shipment is handed over to the responsible party. Delays not caused by TLG do not affect this transfer.

9) Warranty

9.1 Customer satisfaction is top priority. Warranty claims last two years unless otherwise agreed in writing. Customers must inspect upon delivery and report visible and hidden defects within three days.

9.2-9.3 Return, repair, and compensation rules apply as stated above. Exclusions include normal wear, misuse, and parts not covered by warranty.

10) Liability

10.1 TLG is not liable for minor negligence, indirect or consequential damages, or lost savings.

10.2 Liability is also excluded for improper use, force majeure, unlisted original parts, or missed maintenance.

11) Repairs Outside Warranty

Costs for non-warranty repairs are borne by the customer. A cost estimate is provided, and work proceeds only with explicit consent. Non-picked-up repairs may incur 10% of estimated costs.
